In short
- These terms cover use of the SwimNexus website. SwimNexus services such as SwimClubOS and SwimMeetOS are supplied to clubs and organisers under a separate written agreement.
- If a signed agreement and this page differ, the signed agreement prevails.
- Nothing here limits any right or liability that the law does not allow to be limited.
1. Who we are
The website and services are provided by Lewis Plume trading as SwimNexus, a UK sole trader (not a limited company), of 20 Talbot Close, Highbridge, Somerset, TA9 3AX, United Kingdom. Contact: [email protected]. VAT and company registration details are not stated because none are claimed on this site.
2. Using the website
You may browse the site and use its forms for genuine enquiries. Do not misuse the site: do not attempt to gain unauthorised access, interfere with it, scrape it at volume, or submit unlawful, misleading or malicious content. Do not put passwords or sensitive personal details into the contact forms.
3. Information on the site
We aim to keep the site accurate, but it is general information and may change. Product descriptions say whether a product is available, in testing or planned. SwimLeagueOS is planned and is not offered as an operating service. Nothing on the site is a guarantee of availability, outcome or fitness for a particular purpose.
4. Services are supplied under agreements
A club or organiser uses SwimNexus products under a written agreement, for example the Free Pilot Agreement, which includes the Data Processing Agreement and its schedules. Those documents set the commercial terms, fees (a free pilot has none), term, support, data protection, liability and exit arrangements. A trial does not become a paid plan unless a separate agreement is made and accepted. Policies on this site, such as the Provider Access Policy, Support Policy and Export and Exit Policy, explain how we operate; they do not change a signed agreement unless that agreement says so, and a change that would alter your obligations is put to you for acceptance rather than applied silently.
5. Accounts
Keep your sign-in details private, use your own account, and tell us if you think it has been compromised. You are responsible for what is done under your account and for the users you authorise.
6. Intellectual property
The SwimNexus software, designs, text, logos and documentation belong to Lewis Plume trading as SwimNexus or its licensors. Your club keeps its rights in its own records and materials. See who owns and controls your data.
7. Liability
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for any rights data subjects have under data-protection law, or for anything else that cannot lawfully be excluded or limited. Subject to that, we are not liable for loss of profit or indirect or consequential loss arising from use of this website. Liability under a customer agreement is governed by that agreement.
8. Privacy and cookies
Our Privacy Policy explains how we use personal information. The site uses a strictly necessary session cookie and does not use advertising or behavioural-tracking cookies.
9. Changes to these terms
We may update these terms. The version and date are shown at the top of the page. Continued use of the website after a change means you accept the updated website terms; customer agreements are changed only as those agreements allow.
10. Governing law
These terms are governed by the law of England and Wales and the courts of England and Wales have jurisdiction, subject to any mandatory rights you have where you live. Questions: [email protected].
